1. Application of the General Terms and Conditions All orders placed with SYNERGY SA (Nespresso) are subject to these General Terms and Conditions, unless the parties have reached other agreements. Nespresso does not recognise customers' terms and conditions which differ from these terms and conditions. Verbal agreements which differ from these terms and conditions must be confirmed in writing by Nespresso before they can take effect. Nespresso reserves the right to amend these General Terms and Conditions at any time by publishing a new version. 2. Registration Data requested during the registration process (online, on the phone or by fax) must be complete and correct. If the data changes after the registration, the customer must correct the information immediately. 3. Orders 3.1. Nespresso supplies its products from its available stocks. If a specific item is not available, Nespresso must inform the customer of this before accepting the order. 3.3. Nespresso reserves the right to refuse orders, to place restrictions on quantities, to set credit limits and to require advance payments, in particular in the case of unpaid invoices, credit risks or the customer's inability to pay. 4. Entering into a contract 4.1. The customer's order is an offer to acquire the required goods from Nespresso. The order is based on the prices and other information specified on the day of the order. Nespresso accepts the customer's offer by shipping the goods that have been ordered. 4.2. In the case of orders placed online, Nespresso confirms receipt of the order immediately by sending an e-mail to the customer. This confirmation of receipt does not constitute an order confirmation. The acceptance of the offer takes the form of a separate order confirmation which is also sent by e-mail or by phone. 5. Delivery and shipping costs 5.1. Where possible, Nespresso ships the goods that have been ordered on the first working day (Monday – Saturday) after receipt of the order. Unless otherwise agreed, the delivery is made to the delivery address given by the customer. 5.2. The delivery method is decided by Nespresso and cannot be changed. 5.3. The delivery is free for online orders over 50 capsules or 20€ value, and for all other orders, delivery is free for orders with 100 capsules and more for Athens, Greece and for orders with 150 capsules and more for the rest of Greece. 5.4. The risk of loss or damage to the goods is transferred to the customer when the goods are delivered. 5.5. Deliveries are made only to delivery addresses in Greece. 6. Checking the goods 6.1. The customer is responsible for checking the quantity and condition of the goods on receipt. If the goods are damaged or incomplete on receipt, the customer must inform Nespresso within 7 days of receipt of the goods (and must keep the invoice and the delivery note). 6.2. In these circumstances, Nespresso will supply the customer with products of the same value or reimburse the purchase price. 7. Right of return and returning the goods 7.1 The customer has the right to return the goods within 14 days of receipt without giving a reason. In order to make use of the right of return, the customer must inform Nespresso Professional of its decision to return the goods by clearly stating its intention to do so: • by post to: SYNERGY SA, 168 Kifisias str., ZIP code 115 25, ATHENS, GREECE • by fax: (+30) 210 67 11 560 • online at: www.nespresso-pro.com 7.2. Nespresso only accepts returned goods that are in perfect condition, in their original packaging and accompanied by the invoice. After the goods have been returned as specified above, Nespresso will refund the purchase price to the customer within 30 days of receipt of the returned goods. The cost of returning the goods must be paid by the customer. 7.3 The right of return does not apply to deliveries of sealed goods which for reasons of health or hygiene are not suitable for return if the seal has been removed after delivery. 7.4. Returned goods must be sent to the following address: SYNERGY SA, 168 Kifisias str., ZIP code 115 25, ATHENS, GREECE 8. Prices All prices are given in euro (€) exclusive of VAT. The prices listed in the order documents apply until new documents are issued. 9. Payment terms 9.1. Invoices must be paid in full within 30 days. 9.2. Payments by credit card are due and must be made immediately. 9.3. In the case of payment default, default interest will be charged on the balance that is due and any administrative expenses and court costs will also be charged. 10. Manufacturer's warranty and customer services 10.1. Nespresso provides a manufacturer's warranty in accordance with the provisions in the original packaging. 10.2. This warranty does not cover faults resulting from improper use, failure to follow the product instructions, limescale deposits, improper or inadequate maintenance, normal wear and tear, use with a current or voltage other than that specified on the product, unauthorised changes to the product, fire, lightning, floods or other external causes. Damage caused by modifications or repairs not carried out by Nespresso is not covered. 10.3. In the case of a warranty claim, Nespresso will provide the customer on request with a loan machine without a milk frother for the duration of the repair work. This machine is loaned and remains the property of Nespresso. It must be returned to Nespresso immediately after the repair has been completed or on request. 10.4. For information about using your Nespresso Professional machine or for other questions relating to it, please contact Nespresso customer services by phone on (+30) 210 67 11 007 (free of charge). 11. Secure Transaction - transactions through the electronic payment platform of "Alpha e-Commerce" All payments made using the card are processed through the electronic payment platform of "Alpha e-Commerce" of Alpha Bank and uses TLS 1.2 encryption protocol encryption with 128-bit (Secure Sockets Layer - SSL). Encryption is a way of coding the information until it reaches its recipient, who will be able to decode it using the appropriate key. 12. Data protection 12.1 Nespresso does not sell customers' personal data to third parties and processes it in strict compliance with the applicable legislation and the Nespresso data protection policy. Except as provided in Section 3 hereinafter, nothing contained on our Websites shall be interpreted or construed as granting you a licence or a right to use any such content of our Websites. 3. Use of the Websites 3.1. You may download, display or print the content of our Websites solely for personal, non-commercial use, thereby retaining and reproducing each and every copyright notice or other proprietary rights notice contained in any information or other material you download. Any other use, including the reproduction, modification, distribution, transmission or broadcast of the content of the Websites, in whole or in part and by any means, is strictly prohibited, except upon prior written consent by Nespresso. 3.2. Any other information or material communicated to Nespresso through the Internet, by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics or the like, are and will be treated as non-confidential and non-proprietary. Anything you transmit or post becomes the property of Nespresso and may be freely used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Specifically, Nespresso is free to use any ideas, concepts, know-how or techniques contained in any such communication you send to the Websites for any purpose whatsoever, including, but not limited to, developing, manufacturing, advertising and marketing products using such information. WHICH OF YOUR PERSONAL DATA WE COLLECT AND HOW WE USE THEM Depending on how you interact with SYNEGY S.A. (online, offline, over the phone, etc.), we may collect from you various types of information, as described below. Personal Contact Information. This includes any information you may provide to us that would allow us to personally contact you, such as your name, mailing address, e-mail address or phone number. Account login information. Any information that is required to give you access to your specific account profile. This may include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer. Demographic information. Examples may include your date of birth, age or age range, gender, the geographic location (e.g., zip code), favorite products, hobbies and interests, and household or lifestyle information. Any information that we need in order to fulfil a sale, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available).
